The following are terms of a legal agreement between you and Cerchen, Inc.. By accessing, browsing, or using this Web site, you acknowledge that you have read, understood, and agree to be bound by these terms and to comply with all applicable laws and regulations, including export and re-export control laws and regulations. If you do not agree to these terms, please do not use this Web site.

Cerchen, Inc. may, without notice to you, at any time revise these Terms of Use and any other information contained in this Web site by updating this posting. Cerchen, Inc. may also make improvements or changes in the products, services, or programs described in this site at any time without notice.

The Customer agrees to exercise its best efforts to furnish Cerchen, Inc. with accurate and complete information relative to each assignment's needs. The Customer understands that the accuracy of the information provided by Cerchen, Inc. depends in part on the Subject’s birth date and Social Security Number. If this information is not accurate on the search request form, it could cause inaccuracies in the search result. The Customer agrees that all candidates being referenced for employment purposes have signed a written authorization consent form giving the employer and/or its agent, Cerchen, Inc., permission to conduct a Cerchen, Inc. pre-employment screening search.

Unless specified by law, information contained in Cerchen, Inc. reports must be held in the strictest confidence and may not be disclosed directly or indirectly to any persons except those whose official capacity entitles them with "the right to know". Cerchen, Inc. reports are prepared for the sole purpose of personnel selection and may not be used for any other reason or purpose. Cerchen, Inc. provides information only, and plays no role whatsoever in the decision process by the Customer to hire, or not to hire, the job candidate.

Information provided by Cerchen, Inc. is subject to the requirements of 15 United States Code 1681, et seq. (Fair Credit Report Act). Cerchen, Inc. takes its responsibilities under this Act seriously, and will at all times comply with the requirements regarding reporting criminal and credit records for the purpose of employment screening. Unless otherwise requested by the Customer, Cerchen, Inc. will assume that the annual salary exemption set forth in Section 1681c(b) of the Act does not apply and will prepare the reports accordingly.

By requesting a report from Cerchen, Inc., Customer agrees to comply with the requirements of this Act. The Federal Fair Credit Reporting Act imposes criminal penalties (including a fine, up to two years in prison, or both) for anyone who knowingly and willfully obtains information on a consumer from a consumer reporting agency under false pretenses, and other penalties for anyone who obtains such information without a permissible purpose.

Because of these requirements, the Customer is agreeing that by using our services, the Customer has and will maintain a signed, written authorization form. A copy of our standard form may be located by clicking here.

Verification/Consent Forms: These documents call for job candidates to provide important and sensitive information, including their dates of birth. The data that a job candidate provides on Cerchen, Inc. "Pre-Employment Screening Authorization Form" are the property of Cerchen, Inc. and are not to be used for any purpose other than Cerchen, Inc.'s pre-employment screening search.

Billing: All invoices are due and payable net 30 days from the date of the original invoice, unless special arrangements are made. A late charge of 1.5% will be applied every 30 days past the due date. Cerchen, Inc. reserves the right to use all legal means to collect delinquent accounts (those which are 90 days or more past due). Should it be necessary, Customer agrees to pay Cerchen, Inc.’s cost of collection, including attorney’s fees.

All implied warranties, including the warranty of merchantability, are expressly disclaimed, and there are no express or implied warranties made by Cerchen, Inc., except as expressly stated herein. In no event shall Cerchen, Inc. be liable for consequential damages to Customer or any other person. Customer's sole remedy against Cerchen, Inc. shall be a refund of the cost of the service found to violate this agreement.

Information provided by Cerchen, Inc. is taken from pubic records not under the custody or control of Cerchen, Inc. Therefore, information reported by Cerchen, Inc. is only as accurate as those public records are. Users of this information should consult state or federal laws before making business decisions based on the results of a search. Cerchen, Inc. is not liable for claims for damages arising from the use of this data, beyond the cost of performing the search. Because mis-identifications may occur when trying to identify a particular person, based solely on name or other identifiers, extreme care must be used in reviewing and utilizing information available through this site. If there are any questions about the accuracy of the records, Cerchen, Inc. will provide the Customer with copies of the original public records.

For all purposes, Cerchen, Inc. shall be deemed an independent contractor of Customer and Cerchen, Inc. and Customer shall not be deemed agents of each other for any purpose.
